📝 The taxpayer’s right to appeal decisions (actions or inaction) of tax authorities is guaranteed by the Tax Code of the Kyrgyz Republic and the Administrative Procedure Code of the Kyrgyz Republic

📝 The Labor Code of Turkmenistan (hereinafter referred to as the Labor Code) distinguishes two types of employment agreements, one of which is a fixed-term employment agreement. Labor legislation does not define a fixed-term employment agreement. Under article 18, paragraph 2, of the Labor Code, a fixed-term employment agreement is concluded when the employment relationship is not permanent or cannot be established for an indefinite period of time, taking into account the nature of the work to be performed or the conditions under which it is to be performed. In addition, there is an exhaustive list of grounds for concluding a fixed-term employment agreement, as set out in article 18 (3) of the Labor Code, on which it may be concluded.

🔸Арбитраж, как известно, пользуется большой популярностью как способ разрешения споров. Однако на практике при подготовке договора наименование арбитража может быть указано неверно.

В таком случае арбитражная оговорка может оказаться «дефектной», то есть не позволяющей определить уполномоченный арбитраж.

В результате арбитражи с похожим наименованием не признают свою компетенцию в споре (поскольку их наименование прямо не упоминается в оговорке), а государственные суды, в силу процессуальных норм, обязаны возвращать иски по контрактам, где есть арбитражная оговорка. В итоге стороны фактически лишаются права на защиту своего нарушенного или оспариваемого права.

Однако выход есть.

Первый путь: Назначение компетентного арбитража в соответствии с Европейской конвенцией о внешнеторговом арбитраже.

🔸Arbitration, as known, has become a popular method of dispute resolution. However, in practice, during the contract formation, the arbitration may be indicated incorrectly.

For example, when the arbitration naming is ambiguous, or does not even exist. The arbitration clause can become “defective”.

In result, arbitrations with the similar naming do not recognize their competence in disputes (since their naming is not directly mentioned in the clause). While state courts are obliged to return claims under contracts, which include the arbitration clause. Thus, the parties get deprived of the right to protection of their breached or disputed right.

However, there is a solution.

First way: Appointment of a competent arbitration body in accordance with the European Convention on International Commercial Arbitration.

The authors identify key issues, including misinterpretation of arbitration, application of inappropriate legal standards, and excessive procedural requirements outside the New York Convention’s scope.

Recommendations focus on improving judicial competence, systematizing court practice, and ensuring transparent, reliable statistics—drawing on best practices from the PRC judicial system. Such reforms could strengthen investor confidence and improve Kazakhstan’s arbitration landscape.
