【選舉觀察計劃回應有關參與民主派35+初選人士被捕事宜 】


截至二零二一年一月六日中午十二時,至少有50 位人士被警方指違反《國安法》「顛國家政權罪」從而上門拘捕。

香港民意研究所副行政總裁鍾劍華今早接受訪問時指出,初選目的乃為泛民主派的內部協調而設,沒有具體政治綱領、而香港民意研究所只負責操作初選。 選舉觀察計劃必需強調,選舉權利該受保障。基本法第二十六條:「香港特別行政區永久性居民依法享有選舉權和被選舉權」、基本法第三十九條:「《公民權利和政治權利國際公約》、《經濟、社會與文化權利的國際公約》和國際勞工公約適用於香港的有關規定繼續有效,通過香港特別行政區的法律予以實施。」港區國安法第四條更指:「香港特別行政區維護國家安全應當尊重和保障人權,依法保護香港特別行政區居民根據香港特別行政區基本法和《公民權利和政治權利國際公約》、《經濟、社會與文化權利的國際公約》適用於香港的有關規定享有的包括言論、新聞、出版的自由,結社、集會、遊行、示威的自由在內的權利和自由。」以上條文皆明確地保障香港居民自由參與選舉的權利。

選舉觀察組織認為今天的大規模拘捕行動嚴重威脅香港的公民社會、學術機構乃至香港巿民的自由與權利,只會深化管治危機,以「顛覆國家政權罪」之名濫捕 不同政見的人士,必須予以強烈譴責。

[Hong Kong Election Observation Project – Statement on the Mass Arrests of Organizers and Participants of Pan-Democratic 35+ Civil Voting]


Up until 12nn on January 6, 2021, no less than 52 citizens associated with the Democratic 35+ Civil Voting (also known as the pan-democrats primary) in July 2020 were arrested on suspicion of violating Hong Kong’s National Security Law (HKNSL).

Dr. Chung Kim-wah, Deputy Chief Executive Officer of the Hong Kong Public Opinion Research Institute (HKPORI) which provided technical support for the primary, stated in an interview this morning that the sole purpose of the Civil Voting was for the internal coordination between pan-democratic candidates before the Legislative Council Election originally scheduled for early September 2020, HKPORI’s only role was operational.

The Election Observation Project (HKEOP) would like to emphasize that the right to free and fair elections has long been held by Hong Kong people as one of the core values and must be respected. (tbc)

In point of fact, such electoral rights are embedded in the Hong Kong Special Administrative Region Basic Law and supported by a wide range of legal instruments. Article 26 of the Basic Law states “Permanent residents of the Hong Kong Special Administrative Region shall have the right to vote and the right to stand for election in accordance with law”; while Article 39 stipulates that “The provisions of the International Covenant on Civil and Political Rights, the International Covenant on Economic, Social and Cultural Rights, and international labour conventions as applied to Hong Kong shall remain in force and shall be implemented through the laws of the Hong Kong Special Administrative Region.” Moreover, Article 4 of the HKNSL clearly states that “Human rights shall be respected and protected in safeguarding national security in the Hong Kong Special Administrative Region. The rights and freedoms, including the freedoms of speech, of the press, of publication, of association, of assembly, of procession and of demonstration, which the residents of the Region enjoy under the Basic Law of the Hong Kong Special Administrative Region and the provisions of the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights as applied to Hong Kong, shall be protected in accordance with the law.”

HKEOP is of the view that the mass arrests this morning further curtail the rights and freedoms of Hong Kong's civil society, academic institutions and ordinary citizens, this could only serve to deepen the crisis of governance that has plagued the city. Any blatant abuse of powers by the authorities under the HKNSL to silence dissent should be strongly condemned.

《路透社》引述北京消息人士指,北京正考慮修改香港立法會選舉制度,以進一步削弱民主派的影響力,今年9月進行的立法會換屆選舉有可能會再度押後。報道指,50多名參與民主派初選人士被捕,是壓制反對派聲音的連串行動之一,但北京仍然擔心民主派會取得立法會大多數,正考慮改革選舉,處理目前政治架構上的「不足」;另一名消息人士透露,北京同時考慮如何削弱民主派對行政長官選舉委員會的影響力,但具體方案仍未落實,又透露未來至少一年內,北京會推出更多強硬措施,防止香港再出現年半前的混亂局面。

行政長官林鄭月娥透過發言人回應,港區國安法令香港回復穩定,減少街頭暴力,香港人的權利和自由亦獲得保障,會確保立法會選舉開放、公平和誠實進行。//

JOINT STATEMENT:
MYANMAR: STOP THE COUP, LET ELECTION TRIBUNALS DO THEIR JOB

On 1 February, the armed forces of Myanmar (Tatmadaw), ostensibly acting on allegations of voter fraud in the general elections of 8 November 2020, detained numerous government officials, including State Counsellor Daw Aung San Suu Kyi, President U Win Myint, and Union Election Commission (UEC) Chair U Hla Thein, as well as pro-democracy activists and politicians from the ruling National League for Democracy (NLD) and other parties.

The Tatmadaw subsequently announced that it would seize power, declare a one-year state of emergency, and install Vice-President and retired general U Myint Swe as acting president. It was also announced that new elections would be held after the state of emergency under a new election commission, which was later appointed on the night of 2 February.

The undersigned election or human rights monitoring organizations condemn the military coup in Myanmar and call for the immediate release of all detained politicians, government officials, and activists. The Tatmadaw must restore power to the civilian-led government, and seek redress of election-related complaints through the due process of law established under the 2008 Constitution.

Indeed, Myanmar’s Constitution and election laws provide a mechanism to resolve disputes in the form of election tribunals. The military-backed Union Solidarity and Development Party (USDP), which has repeatedly made claims of vote-rigging and irregularities in the recent general elections, has like any other stakeholder the legal right to formally contest election results. It certainly has done so, filing 174 complaints out of the 287 received by the UEC.

Election observers were looking forward to seeing all election-related complaints and potential evidence presented and addressed in tribunal proceedings. According to our information, the UEC was about to proceed with the appointment of election tribunals when the military intervened. Election dispute resolution is an integral part of any electoral process, which rests on the fundamental premise that all sides act in good faith.

Therefore, the Tatmadaw must back down from its coup attempt and instead engage in a peaceful and transparent election dispute resolution process. The road to a fully realized democracy is long and arduous, but it is important that all stakeholders commit to upholding and protecting democratic norms. A repeat of what transpired after the 1990 general elections would mark a stark return to authoritarianism and will not be accepted by the people of Myanmar and the international community.

2月1日,緬甸國防軍─塔瑪都(Tatmadaw)表面上是回應選民對2020年11月8日大選舞弊事件的指控,拘留了許多政府官員,包括國務委員翁山蘇姬(Daw Aung San Suu Kyi),總統溫雲(U Win Myint)和聯邦選舉委員會(UEC)主席U Hla Thein,以及來自世界各地的民主運動人士和政治家執政的全國民主聯盟(NLD)和其他政黨。

國防軍隨後宣布奪權,緬甸進入為期一年的緊急情況(state of emergency),並任命副總統兼前將軍U Myint Swe為代理主席,同時由新的選舉委員會重新舉行一場選舉。

緬甸的觀選團體希望能透過找尋證據,依法解決選舉爭議。根據ANFREL的資料,聯邦選舉委員會其實在軍事政變前就已經任命選舉法庭。解決選舉爭議是任何選舉程序不可或缺的一部分,但運作的前提是,各方都能真誠以待。

鑒於此,我們要呼籲,緬甸國防軍(Tatmadaw)應放棄其政變企圖,改以和平、透明的方式解決選舉爭議。
全面民主化本就是一條漫長而艱鉅的道路,各方利益相關者都應致力於保障民主,這是非常重要的。1990年大選後的殷鑑不遠,威權、非民主的作法是不被緬甸人民與國際社會所接受的!

【選舉觀察計劃就民主派人士被控觸犯《國家安全法》聲明】

據報道,47人因組織或參與民主派於2020年7月舉行的初選,因涉嫌違反串謀顛覆國家政權罪被起訴,全部人不准保釋,明早於西九龍裁判法院提堂。

選舉觀察計劃對此表示痛心。怍為曾為初選進行實地觀察、研究和撰寫報告的計劃,我們強調,選舉權(包括參選、被選和投票的安排)必須得到保障和尊重,香港市民一向重視程序公義、亦相當重視透過一人一票的方式彰顯民意,這也說明了有60多萬市民積極參與初選的本質和重要性。

我們認為,香港的出路,在於真正的民主發展和管治改革。政府現在選擇用《國家安全法》的權力對付民主派的人士,向籌備社會活動的人冠上「顛覆」的罪名,無限上綱,做法跟不民主的政府打壓異己的手段無異,只會繼續深化矛盾。

事實上,自2016年起,民主派人士的參選空間不斷地收窄,近日更有消息指出中央政府正謀求直接改變香港選舉制度。選舉觀察計劃於2月26日公佈的「我們香港人意見群組」民調結果顯示,若今年9月舉行立法會換屆選舉,這次選舉有多公平,結果57%人認為選舉將是不公平。87%的民主派支持者、39%的非民主派支持者均大比數認為選舉將是不公平。連串的舉動已經破壞了選舉的公平性和選舉結果在市民眼中的公信力。

Statement from Election Observation Project Re. NSL charges of Pan-Democrats

As reported earlier today, a total of 47 persons were charged for subversion under the national security laws allegedly due to their organizing and participating in the primary election held last year. None of then was granted bail.

We are gravely concerned and distressed by the news. EOP, as the organization that had observed on site and subsequently compiled the report on the primary election, stresses that the right to vote (including the right to run, to vote and to be voted) has to be respected and protected by all. Hong Kongers have always placed utmost emphasis on procedural justice and public mandate through one person, one vote. It speaks to the nature and importance of the primary election, participated by more than 600,000 people of Hong Kong.

We are of the view that genuine democratic development and governance reform are the only ways out for Hong Kong. The government’s choice to crack down on organisers of civil activities, by overstretching the powers of NSL and completely over-interpreting the original intention for the primary. It will only serve to deepen the divisions in the society if our government continues to clamp down on dissents undemocratically.

In fact, the room for the pro-democratic camp to participate in elections has been shrinking since 2016. Worse still, it is reported that the Chinese government is seeking to directly intervene in and pass down electoral reform without due process. On 26 February, the EOP released the results of a public opinion survey, which found that 57% of Hong Kong people would see the election as unfair should it were to be held in September this year. In particular, 87% of pro-democracy supporters and 39% of non-pro-democracy supporters see that the election will be unfair. This shows that attempts by the authorities to intervene in electoral matters have already destroyed the fairness and legitimacy of elections in Hong Kong.
