No Tax on Tips Details
The "no tax on tips" provision, part of the recently signed One Big Beautiful Bill Act (OBBBA), allows eligible workers to deduct up to $25,000 in tip income from their federal taxable income for tax years 2025 through 2028. This deduction phases out for individuals earning more than $150,000 and couples earning over $300,000 annually.
The deduction is an above-the-line tax break, meaning it does not require itemizing deductions.
To qualify, tips must be received in occupations that traditionally and customarily receive tips, such as food service, taxi driving, or personal care services. The Treasury Department is required to publish a list of qualifying occupations within 90 days of the bill's enactment.
Tips must be reported to employers for payroll tax purposes, and the deduction applies only to cash tips, including those paid via credit or debit cards, and tips received under a tip-sharing arrangement. Non-cash tips, such as gift baskets or movie tickets, do not qualify.
The provision aims to benefit tipped workers by allowing them to keep more of their earnings, though critics argue that the majority of low-wage tipped workers may see little to no benefit, as they often owe little to no federal income tax already. According to the Tax Policy Center, about 60% of households reporting tip income would benefit, with an average tax savings of $1,800 per year.
However, the Economic Policy Institute notes that the top 20% of tipped workers would receive an average tax cut of $5,768, compared to only $74 for the bottom 20%.
